By using the Tools, you accept the terms and disclaimers listed below and confirm your agreement with them. („The liability disclaimer “)

1. General Disclaimer

The Tools listed on the Reforest Tools Page have been developed with support from the Reforest project to assist users in various activities. These Tools are provided for informational and educational purposes only and are not intended to replace professional advice or decision-making. Users assume full responsibility for the application of the Tools in their respective contexts.

2. No Guarantee of Accuracy or Suitability

The Reforest project and its contributors make no representations or warranties, express or implied, regarding the accuracy, reliability, completeness, or suitability of the Tools for any specific purpose. The Tools may include technical inaccuracies or typographical errors, and updates may not be reflected immediately.

3. Limitation of Liability

To the fullest extent permitted by law, the Reforest project, its partners, contributors, or associated organizations shall not be held liable for any direct, indirect, incidental, consequential, or special damages arising out of or in any way connected with the use or misuse of the Tools. This includes, but is not limited to, damages for loss of data, profits, or business opportunities.

4. User Responsibility

Users are solely responsible for ensuring that their use of the Tools complies with applicable laws, regulations, and standards. It is the user’s responsibility to verify the suitability of the Tools for their specific applications and to seek professional advice where necessary. Furthermore, users must not infringe intellectual property rights or the rights of third parties in connection with the use of the Tools. Users are also prohibited from using the Tools in a manner contrary to good morals or in a way that could harm the rights of third parties.

5. Data Privacy and Security

  • For the Reforest Public Goods Tool, any data collected are managed by the University of Reading, which ensures data privacy and security according to its Privacy Policy (Privacy – the University of Reading). Participants engaging with this Tool are provided with detailed information sheets outlining the purpose, scope, and data handling practices and are required to sign consent forms prior to any data collection. This ensures that data privacy and security are upheld to the highest standards and that participation remains voluntary.
  • For the Soil Carbon Estimator Tool, any data collected through the Tool are handled in strict compliance with CZU Prague’s personal data protection, data policy and security standards, in accordance with the General Data Protection Regulation (GDPR). Users should refer to CZU Prague’s specific GDPR compliance documentation for detailed information.
  • For the FarmTree Tool, FarmTree is fully responsible for all aspects of data collection, management, and security. Users are subject to FarmTree’s data policy and privacy terms when using this Tool.
  • The use of all other Tools is subject to the Data Policy – Reforest project, which outlines standards and practices to ensure that data privacy and security are maintained consistently.

6. Tools Managed by Third Parties

The FarmTree Tool is managed independently by its administrators at FarmTree. Reforest does not assume responsibility for the content, functionality, data handling, or liability terms of this Tool. Users engaging with the FarmTree Tool are subject to its policies and should refer to the FarmTree Privacy Policy FarmTree for more information. Reforest disclaims all liability for any issues, damages, or disputes arising from the use of the FarmTree Tool.

7. User Conduct

Users agree to use the Tools in good faith and not to engage in activities that could harm the functionality, integrity, or reputation of the Tools or violate applicable laws. Prohibited activities include unauthorized modifications, reverse engineering, or any use intended to harm other users or the environment.

8. Third-Party Tools and Resources

The Tools may integrate or reference third-party resources, datasets, or software. The Reforest project does not endorse or assume responsibility for the content or functionality of such third-party resources. Any reliance on third-party Tools is at the user’s own risk.

9. Support and Maintenance

The Reforest project does not guarantee the provision of ongoing support or updates for the Tools. While efforts are made to ensure functionality, users should note that Tools are provided “as is” without obligation for maintenance or enhancement.

10. Termination of Use

The Reforest project reserves the right to terminate or restrict access to the Tools at its discretion, without prior notice. Users found in violation of these terms may have their access revoked.

11. Intellectual Property

The Tools are protected by intellectual property rights. Users may not reproduce, distribute, modify, or create derivative works without explicit permission, unless stated otherwise in the applicable licenses. All content within the Tools (texts, photographs, images, logos, and software) is protected by copyright and may also be subject to additional rights held by third parties. No licenses or rights to trademarks, patents, trade secrets, technologies, products, processes, or other proprietary rights are granted to users without explicit authorization. Users are strictly prohibited from altering, copying, reproducing, or distributing the content for any purpose without the copyright holder’s consent, including making photographs or texts available, whether for free or for a fee. Product, service, company, and business names or designations may be registered trademarks of their respective owners and may only be used with their written consent.

12. Severability

If any part of this liability disclaimer is found to be unenforceable under applicable law, the remaining provisions shall continue to be valid and enforceable.

13. Entire Agreement

This liability disclaimer constitutes the entire agreement between users and the Reforest project regarding the use of the Tools, superseding any prior agreements or understandings.

14. Governing Law

This liability disclaimer and any disputes arising from it shall be governed by and construed in accordance with the laws of Brussels. All disputes shall be subject to the exclusive jurisdiction of the courts of Brussels.

15. Indemnification

By using the Tools, users agree to indemnify and hold harmless the Reforest project, its contributors, partners, and affiliates from any claims, damages, or expenses (including legal fees) arising out of their use of the Tools.
